Jussie Smollett smiled on a day on the beach in Hawaii on Wednesday as he enjoyed some downtime with his family as the legal ramifications of his sensational Chicago case raged.
The 36-year-old Empire actor was portrayed laughing while eating, talking to his sisters, and unloading a car with children's bags and towels to spend an entertaining day.
They were spotted at the Kaloko-Honokōhau National Historical Park in Kailua on the Big Island.
It is unclear how long he has been in Hawaii. His sisters Jazz and Jurnee supported him throughout his case, but did not visit the court as often as his brothers.
The actor was last seen flying to Los Angeles within a few days after 16 crimes lied to the police.

The 36-year-old empire actor was in high spirits when he unloaded beach utensils from the car and ate what looked like a Dorito
Smollett wore his characteristic silver aviator goggles and looked relaxed as he ran across the parking lot before loading himself up with items that he wanted to bring to the beach.
He was wearing a white t-shirt, black hat, black shorts and sandals.
Sometimes the star looked tense when he answered a call and sat in the car, but his good mood showed again when he went to the water with his nieces, nephews, sisters and brother-in-law.
Smollett was accused of staging an attack on himself on January 29 to try to elevate Empire. Police say he paid Abel and Ola Osundairo to beat him in a racist, homophobic attack by two Trump-loving offenders.
The case against him was suddenly and unexpectedly terminated by the prosecutor last month in questionable circumstances.
Prosecutor Kim Foxx, whose office was responsible for the investigation, has been repeatedly asked to step down on her case.

Smollett wore black shorts, a white t-shirt, blue slides, and a black hat, as well as his signature silver sunglasses that were common during his Chicago court appearances
Smollett was also less smiley when he was in the car. He seemed to be looking at something on his cell phone

At the start of the investigation, she exchanged text messages with members of Smollett's family and, at her request, tried to persuade the Chicago police to let the FBI take the lead.
Chicago Police Department superintendent Eddie Johnson was horrified when her office decided to drop the case, as did Mayor Rahm Emanuel.
They say it sent a clear message that Smollett was preferred because he has friends in high positions and there was a widespread outcry about the decision in public.
The Chicago police union has given a vote of no confidence against her and even lawyers who previously worked for her and requested her investigation. Among them is Saani Mohammed, who filed a petition asking for an investigation into the actions of Kimberly Foxx, the Cook County prosecutor, for deciding to drop the 16 crimes against the Empire actor.

Smollett follows his niece to the national park on Wednesday and carries some towels with him. His lawyers say that Chicago's treatment of him is on the verge of harassment

Smollett has been publicly surrounded by his siblings since the outbreak of the scandal. His brothers, who were on trial with him, were not there for the beach trip on Wednesday
According to court records, Mohammed, who until recently worked in Foxx’s office, wrote that a prosecutor should investigate whether Foxx "is interfering with the investigation … intentionally misleading hidden evidence and / or misleading the public."
Foxx also wrongly used her position to intervene in the investigation after meeting with a Smollett relative before the charges were dropped, the Chicago Tribune file said.
Smollett's team never offered an alternative explanation of why the brothers he knew and paid for personal training would attack him.
However, one of his lawyer's most bizarre attempts to explain the case was that he told the police that one of his attackers was white because the Nigerian brothers "may have painted white".
The brothers told the police that Smollett had recruited her to beat him up and that he betrayed her by going to the police and claiming that she knew nothing about the incident.
Smollett was arrested in February for allegedly lying about the attack. The police say he paid Abel and Ola Osundairo to attack him, and he thought he could use it as a lever to raise the empire, a claim he denies
